Terms of Use
These terms apply to your use of jbtechnology.ca, including its project estimator and consultation booking. JB Technology is operated by Jordan Bretiller in Calgary, Alberta ("JB Technology", "we", "us"). By using the site you agree to these terms. If you don't agree, please don't use the site.
1. Projects and proposals
JB Technology designs and builds websites, custom software, booking tools and estimators, and offers hosting and care plans. Project work begins only after you accept a written proposal or agreement that sets out the scope, price, payment schedule, timeline and who owns what. If a proposal or agreement and these terms disagree, the proposal or agreement applies to that project.
2. Estimates and prices
- The project estimator gives an approximate price range based on your answers. It is a guide, not a quote or an offer. Your price is set in a written proposal after we review your needs.
- Example figures on the site, such as the prices on the animated estimator at the top of the home page, are illustrations.
- Prices are in Canadian dollars and do not include GST unless stated. Care plans are billed monthly as set out in your proposal.
3. Consultation requests
Sending the estimator's email is a request, not a confirmed appointment. We confirm consultation times by email, normally within one business day. Please give accurate contact details and don't send passwords or payment details through the estimator or by email. We may decline requests that look automated, abusive or outside the services we offer.
4. Our work and portfolio
Projects shown on the site (such as JBPMC and QuoteRidge) are examples of our work and tools. Descriptions are accurate to the best of our knowledge but are not promises of the same results for your business. We don't guarantee search rankings, traffic, leads or sales from any website or tool.
5. Third-party services
Many projects rely on services from other companies, such as domain registrars, hosting providers, email, scheduling, payment and map services, fonts and software libraries. Those services are provided under their own terms and prices, which can change. We are not responsible for their outages, policy changes or price increases, but we will help you deal with them under your care plan or at our standard rates.
6. Acceptable use
You agree not to:
- copy, scrape, download in bulk or mirror the site or its code, including with automated tools;
- try to get around the site's security or spam protection;
- send spam, false information or harmful code through the estimator or by email;
- use the site in a way that breaks the law or harms JB Technology or other users.
7. Content and ownership
This site's text, design, code, animations, estimator and logo belong to JB Technology and are protected by copyright. You may view pages for your own use. You may not reproduce, sell or publish them, or use them to build a competing product, without our written permission.
For client projects, ownership is set out in your proposal or agreement. Unless it says otherwise: once the project is paid in full, you own the content you provide and the final design created for you; JB Technology keeps ownership of its pre-existing code, templates, tools and components and gives you a permanent licence to use them in your project; and we may show the finished project in our portfolio.
Links to other websites are provided for convenience. We don't control those sites and aren't responsible for their content or privacy practices.
8. Liability
This website and its estimator are provided "as is" and "as available". To the extent the law allows, JB Technology is not liable for any indirect, incidental or consequential loss, or for loss of profits, data or business, arising from your use of this website or its estimator, or from the website being unavailable. Our total liability for any claim about this website is limited to $100. Liability for project work is governed by your proposal or agreement.
Nothing in these terms limits any right you have that cannot be limited by law.
9. Governing law
These terms are governed by the laws of Alberta and the federal laws of Canada that apply in Alberta. Any dispute about them will be handled by the courts in Calgary, Alberta.
10. Privacy
Our Privacy Policy explains how we handle personal information collected through the site and our projects.
11. Changes to these terms
We may update these terms. The date at the top shows the latest version, and continued use of the site after a change means you accept the updated terms.
